Business (Innovation) Stream SUBCLASS 188A:

The Business Innovation stream is for affluent owners or part owners of a business who want to have a major management role in a new or existing business in Australia.

This four-year temporary visa is for Business owners who intend to establish business operations in Australia or purchase an existing business.This visa is the first stage to get a Permanent Residence visa in Australia.There is an option to get this visa extended by an extra 2 years. The extension becomes available once you have held the subclass 188 visa for at least 3 years. In other words, one can extend his/her stay to 6 years from the date of the original visa.

THE MAIN CRITERIA:

  • Ownership of a business with turnover of at least AUD 500,000 for 2 of the last 4 fiscal years.
  • Net personal and business assets of at least AUD 800,000.
  • Have an overall successful career in businessor investment
  • Expression of Interest to be lodged
  • Invitation to apply through Skill Select
  • No minimumEnglish language requirement
  • Under 55 years of age (exemption available in exceptional circumstances)
  • Meet thepass markin the Business Innovation and Investment Points test (currently 65 points) 

Nomination by a State/territory government Business Innovation Stream Subclass 188A

This is one of the most important requirements – the visa applicant is required to be nominated by an Australian State or Territory government (example Victoria, New South Wales, Western Australia, Australian Capital Territory, etc)

Innovation Points test

The visa applicant is required to score at least 65 on the Innovation Points test. Points are awarded for:

  • Age
  • Business experience
  • Net personal and business assets
  • Business turnover
  • Innovation (example: exports, patents, unique business idea, etc)
  • English language proficiency
  • Academic/vocational qualifications

BUSINESS (INVESTMENT) STREAM SUBCLASS 188 B

 This option is for those Business professionals who have have managed investments or owned a business and who want to invest AUD 1.5 million in a Australian State or Territory Government bonds

THE INVESTOR STREAM APPLICANTS MUST MEET THE FOLLOWING REQUIREMENTS:

  • You have had business and personal net assets of at least AUD 2.25 million for the last 2 fiscal years
  • You must make an investment of AUD 1.5 million in Australian State or Territory bonds prior to grant of the visa
  • Must be nominated by a State/Territory government and invited by the Australian Department of Immigration and Border Protection (DIBP) to apply for visa
  • No minimum English language requirement
  • Upper age limit of up to 55 years
  • Have a high level of management skill in relation to eligible investments and/or qualifying business activity
  • Have at least three years’ experience of direct involvement in managing business
  • Make the government-approved designated investment before a visa can be granted

Nomination by a State/territory government , the applicants for the Investment Stream are also required to be nominated by an Australian State or Territory government (example Victoria, New South Wales, Western Australia, Australian Capital Territory, etc)

INVESTMENT POINTS STREAM

The visa applicant is required to score at least 65 points on the innovation points test. Points are awarded for the following criteria:

  • Age
  • Business experience
  • Net personal and business assets
  • Business turnover
  • Innovation (example: exports, patents, unique business idea, etc)
  • English language proficiency and
  • Academic/vocational qualifications

Business visa (Significant Investment) subclass 188C

This is a 4 year temporary visa. Once you have maintained an investment in Australia for 4 years, you can apply for permanent residence through the Business Innovation & Investment (Residence) Subclass 888visa.

Besides meeting the common criteria for all the Business Innovation and Investment (subclass 188) stream visas, the applicants must meet the following criterion for the Significant Investor visa to be granted:

  • An investment of at least AUD 5 million in a Complying Investment
  • Visa holder required to spend just 160 days out of 4 years in Australia to get Permanent visa
  • Have a genuine and realistic commitment to continue your business and investment activity in Australia
  • Reside in the state or territory that nominated you;

Complying Investment

  A “COMPLYING INVESTMENT” FOR THE PURPOSES OF THE SIGNIFICANT INVESTOR VISA INCLUDES:

  • State/Territory government bonds; or
  • ASIC regulated managed funds making investments in Australian assets; or
  • Direct investment into unlisted Australian companies
